Welcome to the Privacy Policy of Sir+.This policy is intended to help you better understand what your privacy rights are and how we collect, use, store, protect and share your information. We suggest you read this policy in conjunction with our Terms & Conditions. PLEASE READ THE PRIVACY POLICY and TERMS & CONDITIONS CAREFULLY BEFORE CREATING A FREE OR PAID ACCOUNT. By creating an account and accessing and using the Services, you are agreeing to the terms of this Privacy Policy and the Terms & Conditions. IF YOU DO NOT AGREE TO BE BOUND BY THE PRIVACY POLICY AND TERMS & CONDITIONS, DO NOT USE THE APP OR THE SERVICES.This Privacy Policy applies to our apps and any other of our services. For simplicity, we refer to all of these as our “Services” in this Privacy Policy. “We”, “Us”, “Our” or the “Company” means 11435272 CANADA INC (as described in s. 10 below). “Member”, “You” or “Your” means the person accessing or using the Services.We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal or regulatory reasons (ex: the European Union’s General Data Protection Regulation). If we make material changes to this Privacy Policy, we will give you notice of such changes by posting the revised policy on our App. By continuing to use our Services after these changes are posted, you agree to the revised policy.
1.INFORMATION WE COLLECT
In order to help you develop meaningful connections, we need some information about you, such as basic profile details and the types of people you’d like to meet. We also collect information that you generate as you use our service, such as access logs. Here are additional more details:
1.Registration Information
When you download the App and create an account, we may collect certain information about you, such as:
Name;
Username;
Email address;
Date of birth;
Photographs;
height;
weight;
physical characteristics;
ethnicity;
relationship status;
location; and
any other information you voluntarily provide us with in connection with your registering and using the Services.
You will also be required to create a password when you register for your account with us. You may voluntarily decide to provide us with information that may be considered “special” or “sensitive” in certain jurisdictions, such as your gender identity, ethnicity, personal interests, relationships and preferences, health details and whether part of the POZ (HIV positive) community (for example, in creating or updating your profile), and content in certain photos. We do not require you to provide such sensitive information. Where you choose to provide us with such sensitive information, you are explicitly consenting to our processing of your information.Once you register, you will be able to review and change your registration information at any time by accessing your “Profile” page. You control your user profile and are able to correct or update your information at any time by just logging in to Sir+.The information we collect helps us help you to make meaningful connections, and helps to enhance the App and verify our Users.
2. Once Registered
We collect your insight into our Services in any voluntary surveys and focus groups. For example, you may respond to our questions or provide testimonials.
We collect any registration or other information related to promotions, events and contests.
If you contact our customer care team, we collect the information you give us during the interaction. Sometimes, we monitor or record these interactions for training purposes and to ensure a high quality of service.
If you ask us to communicate with or otherwise process information of other people (for example, if you ask us to send an email on your behalf to one of your friends), we collect the information about others that you give us in order to complete your request.
Of course, we also process your chats with other users as well as the content you publish, as part of the operation of the services.
3.Automatically Collected Information
Usage Information
We collect information about your activity on our Services, for instance how you use them (e.g., date and time you logged in, features you’ve been using, searches, clicks and pages which have been shown to you) and how you interact with other users (e.g., users you connect and interact with, time and date of your exchanges, number of messages you send and receive).
Device Information
We may collect information about your device when you use the App, including the unique device identifier, device model, operating system and MAC address. Other Information with your consent
If you give us permission, we can collect your precise geolocation (latitude and longitude) through various means, depending on the service and device you’re using, including GPS, Bluetooth or WiFi connections. The collection of your geolocation may occur in the background even when you aren’t using the services if the permission you gave us expressly permits such collection. If you decline permission for us to collect your geolocation, we will not collect it.
HOW WE USE INFORMATION
The main reason we use your information is to deliver and improve our Services.
Additionally, we use your information to help keep you safe. We use your information for the following purposes:
offer you our Services and its features;
show users’ profiles to one another;
contact you with information about the App (e.g., updates and new offerings);
personalise the App and the content we deliver to you;
improve our services by conducting research and analysis of users’ behaviour to improve our offerings and content;
develop new features and services;
to respond to your inquiries and comments (for example, regarding support, employment or other requests);
address ongoing or alleged misbehavior on our Services, and perform data analytics to better understand and design ways to prevent these activities;
resolve disputes between you and other users of our Services;
retain data related to fraudulent activities to prevent against recurrences;
investigate fraud, protect our legal rights, and to enforce our Terms & Conditions;
comply with legal requirements, and assist law enforcement.
DISCLOSURE OF INFORMATION
It’s our goal to help you make meaningful connections, so of course, the main sharing of your information is with other users. We also share some users’ information with service providers, and in some cases, with legal authorities. Here’s some additional information.
1.With Other Users
When you voluntarily disclose information on the Service (including your public profile), you share information with other users. Your geographic location and online status may also be visible on the App.
If you chose to limit the audience for all or part of your profile or for certain content or information about you, then it will be visible according to your settings. Regardless of the settings that you choose, DO NOT INCLUDE INFORMATION IN YOUR PROFILE OR OTHERWISE PROVIDE INFORMATION WHEN USING THE SERVICES THAT YOU WANT TO KEEP PRIVATE (EX: GEOGRAPHIC LOCATION, TRAVEL PLANS AND OTHER INFORMATION). For any content that you share, make sure that you’re comfortable with it being publically viewable, since neither you nor we can control what others do with it once you share it. Furthermore, some sophisticated users who use an App in an unauthorized manner may be able to obtain certain profile information that you’ve asked to be non-public. Consequently, assume that anything you post or submit on the App may be publicly-viewable and accessible, both by users of the App and non-users of the App.
2. With Our Service Providers
We use third parties to help us operate and improve our Services. We may share any information about you with these third parties, but only for the purposes of performing these functions and providing such services (e.g. data hosting, maintenance, analytics, customer care, marketing, security operations).
3. Business Transfers
We may transfer your information if we are involved, whether in whole or in part, in a merger, sale, acquisition, divestiture, reorganization, dissolution, bankruptcy, or other change of ownership or control.
4.Law and Harm
We think it’s important that our members respect each other while using the App. We may disclose your information when we believe disclosure is necessary to comply with an order, subpoena, warrant or other legal requirement issued by a court, tribunal, regulator or other person with jurisdiction to compel disclosure of your personal information. We may disclose your information if reasonably necessary to assist in the prevention or detection of crime (subject in each case to applicable law), or to protect the safety of any person. We may cooperate with all third parties to enforce their intellectual property or other rights.
5.Enforce Legal Rights
We may also share information: (1) if disclosure would mitigate our liability in an actual or threatened lawsuit; (2) as necessary to protect our legal rights and legal rights of our users, business partners and other interested parties; (3) to enforce our agreements with you; and (4) to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing.
7. Your Consent
If you consent, we may otherwise share or disclose your information with third parties. In any such case, we will make it clear as to why we want to share the information.
DATA STORAGE
By using the App, you acknowledge that Sir+ is a global app operating through servers located in a number of countries around the world, including Canada and the United States. If you live in a country with data protection laws, the storage of your personal data may not provide you with the same protections as you enjoy in your country of residence.
YOUR RIGHTS
1.Your Information
You may access and modify your registration information at any time, and you may permanently delete your account. When your account is deactivated, we take reasonable efforts to make sure it is no longer viewable on the App. For up to 30 days, you can restore your account. After 30 days, we may choose to begin deleting your account from our systems. We are not responsible for any information (including pictures, correspondent or other content) that is deleted after deactivation. See s. 9 regarding retention.
2. Push Notifications
You can at any time request opt out from further allowing us to send you push notifications by adjusting the permissions in your mobile device.
3. Email Communications
When you receive promotional email communications from us, you can indicate a preference to stop receiving promotional email communications from us by following the “unsubscribe” instructions. We may still send you email communications relating to the Services.
4. Reviewing and Updating Your Information
Applicable privacy laws may give you the right to review the personal information we keep about you. You can request a copy of your personal information by putting in such a request here info@sirplusmen.com. If you believe the information we hold about you is inaccurate or that we are no longer entitled to use it and want to request its rectification, deletion, or object to its processing, please contact us here info@sirplusmen.com.
AGE
You must be at least 18 years old to use our Services. Sir+ does not knowingly collect any information about or market to children, minors or anyone under the age of 18. If you are less than 18 years old, we request that you do not submit information to us. If we become aware that anyone under the age of 18 has registered with us and provided us with personal information, we will take steps to terminate that person’s registration and delete their information, and we may retain your email and IP address to ensure that you do not try to create a new profile.
SECURITY
We take administrative, technical and physical measures to safeguard your personal information against unauthorized access or disclosure, theft and misuse. As with all technology companies, although we take steps to secure your information, we do not promise that it will always remain secure. Please use caution whenever submitting information through the Services and think carefully about what type of information you wish to provide to us.If you ever think someone has had access to your password or otherwise obtained unauthorized to your account, please contact us at info@sirplusmen.com. WE EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ANY BREACHES OF SECURITY, DAMAGE TO YOUR DEVICE OR ANY LOSS OR UNAUTHORIZED USE OF YOUR REGISTRATION INFORMATION OR OTHER DATA.
RETENTION
We keep your personal information only as long as we need it for legitimate business purposes as set out in ss. 3 and 4 and as permitted by applicable law. In practice, we tend to delete or anonymize your information after 30 days of deletion of your account or after two years of continuous inactivity, unless:
1. we must keep it to comply with applicable law or to evidence such compliance;
2.there is an outstanding issue, claim or dispute requiring us to keep the relevant information until it is resolved; or
3.the information must be kept for our legitimate business interests, such as fraud prevention and enhancing users’ safety and security. For example, we may need to keep information in order to prevent a user who was banned for unsafe behavior or security incidents from opening a new account.
